Recently, the public was re-shaken by the disclosure of the syndicate network of buying and selling babies across countries. Based on reports Kompas.comWest Java Regional Police officers succeeded in arresting 13 suspects involved in this human trafficking, and saved six babies who were about to be sent to Singapore. This heartbreaking facts open the eyes of many people that the practice of crime against children is still ongoing and systematic.

This syndicate is known to work neatly. There are those who recruit pregnant women, some accommodate babies, to those who take care of fake documents for illegal administrative completeness. This reality is not only a matter of state law, but also crashes into the basic principles Islamic teaching about human honor.

In Islam, babies both humans, children, or adults-are independent creatures that cannot be sold. Human sales, including babies, belong to major crimes that not only violate human rights, but also stepped on high dignity of humanity in sharia.

Haram is traded

Sykh Muhammad bin Salim bin Sa’id Baasahil Palam Kitab Is’adur Rafiq expressly states:

It is prohibited, and does not apply to sales

Meaning: “Haram and invalid buying and selling something that cannot be owned, like an independent man.” (Is’adur Rafiq, Haramain: 1931, Volume I, p. 137)

That is, a baby born as an independent human being does not include ownership goods (malls), so that it sells it is haram and canceled according to fiqh law.

Selling babies is not just an illegitimate action according to law, but is also a form of great tyranny that deprives the most basic rights of a child – the rights to be cared for, protected, and grow in the arms of affection. Ironically, not a few parents try to justify this action under the pretext of economic difficulties. In fact, in Islamic teachings, economic reasons have never been a justification for illicit and immoral acts like this. Islam firmly forbade all forms of transactions that demean human dignity, especially when it comes to children who are still holy and weak.

Sayyid Abdurrahman Al-Hadrami in this book Bughyatul Mustarsyidin add the following explanation:

It is not permitted to sell children for their success for the hypocrisy of free sales ban, and if they have sold father or other people, then that is the same. And not for them to be help

Meaning: “It should not sell children because they need a living. Buying and selling of humans is haram. If a father or other person sells children, then the selling price is the responsibility of the seller and the buyer does not have the right to the child.” (Bughyatul Mustarsyidin, Darul Minhaj: 2018, Juz I, p. 143)

This shows that even parents do not have the right to sell their children. Economic needs cannot be a justification for violations of the baby’s trafficking.

Hard threat from Rosululloh SAW

Islam not only prohibits this practice, but also gives a strong threat to the perpetrators. Rosululloh SAW said:

Third, I am their characteristics on the day of resurrection … and a free man

Meaning: “There are three groups that will be my opponent on the Day of Judgment … Among them are people who sell independent people and then eat the proceeds of their sales.” (HR. Imam Bukhori)

No matter how big it is, people who sell each other will face Rosululloh in the afterlife.

The rise of the case of buying and selling babies is also inseparable from the role of social media and digital platforms that are used as hidden transaction tools. Many transactions occur behind a closed group or anonymous account. This is where the importance of digital literacy – is not only to prevent hoaks and slander, but also fortify people from very dangerous technology -based crimes.

Society needs to be more vigilant, aware of the law, and understand that maintaining human dignity is part of worship. Moreover, children are mandate, not commodities.
